Terms of Service
Agreement with Caribbean Hearts LLC
These Terms are between you and Caribbean Hearts LLC, which operates the Caribbean Hearts service.
Eligibility and account responsibility
- You must be at least 18 years old and legally able to enter this agreement.
- You must provide accurate information and maintain one personal account.
- You are responsible for your credentials and activity performed through your account.
- Minors are prohibited from using Caribbean Hearts.
- Caribbean Hearts may require independent adult age assurance before member interaction or paid checkout. Registration self-attestation is not independent verification. If assurance cannot be completed, social access may remain restricted while safety, support, credential, export, and deletion controls remain available.
Community conduct
You agree to follow the Acceptable Use Policy (Community Guidelines) and Trust & Safety Policy. Fake profiles, scams, harassment, sexual harassment, stalking, threats, hate speech, human trafficking, sexual exploitation, abuse, solicitation for money, impersonation, blackmail, illegal activity, and non-consensual intimate material are prohibited.
You may not aid, abet, encourage, promote, facilitate, or knowingly enable abuse, sexual harassment, sexual exploitation, human trafficking, harassment, or other unlawful or harmful conduct through Caribbean Hearts.
Dating-service limitations
Caribbean Hearts supports introductions between adults but does not guarantee any member's identity, intentions, background, compatibility, conduct, or relationship outcome. Use good judgment, protect personal and financial information, and meet responsibly.
Content and license
You retain ownership of content you submit. You grant Caribbean Hearts a limited, worldwide license to host, reproduce, display, and process that content only as needed to operate, secure, moderate, and improve the service. You must have the rights to content you upload.
Paid services
When a paid membership is separately activated, offered, and purchased, it renews automatically until cancelled unless checkout states otherwise. Pricing, billing, cancellation, and refund rules are described in the Subscription, Cancellation & Refund Policy. Safety, reporting, blocking, and support are not conditioned on payment.
Enforcement and termination
We may warn, restrict, suspend, or remove accounts when reasonably necessary to protect members, enforce these terms, comply with law, or address fraud and security. Members may request account deletion subject to the Account Deletion & Data Policy.
Disclaimers and limitation of liability
The service is provided on an "as available" basis to the extent permitted by law. Nothing in these terms excludes rights or liabilities that cannot legally be excluded, including non-waivable rights applicable in a member's place of residence.
Informal dispute resolution
Before beginning arbitration or a court action other than qualifying small-claims or urgent injunctive proceedings, the parties will attempt good-faith informal resolution for 30 days after written notice. The notice must describe the dispute, requested relief, and reliable contact information.
Individual arbitration and opt-out
Applicable United States disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, where legally enforceable. The Federal Arbitration Act governs where legally appropriate. Qualifying small-claims rights are preserved. Class, collective, and representative proceedings and jury trial are waived only to the extent legally permitted.
A member may opt out of arbitration within 30 days after first accepting these Terms through the durable Arbitration Opt-Out control in Account Settings. The record preserves the member identifier, Terms version and acceptance date, opt-out date and status, and evidence reference. Opting out does not terminate the account or alter other Terms.
Governing law and court venue
New Jersey law applies, subject to the Federal Arbitration Act where appropriate and to mandatory rights and jurisdictional protections applicable in a member's residence. Matters properly proceeding in court rather than arbitration may be brought in an appropriate New Jersey state or federal court, unless non-waivable law requires another forum.
Service of process
Ordinary support channels do not accept formal service of process. Formal service must use Caribbean Hearts' legally designated registered-agent or process mechanism. The business mailing address and ordinary support workflow are not represented as formal service of process.
Changes
Material changes will receive a new version and effective date. Where required, we will provide notice or request renewed consent.
Contact
Caribbean Hearts LLC oversees initial communications. Use the categorized Contact Support workflow whenever possible. The central business mailing address, support email, and support telephone are listed on Contact & Legal Notices. Do not send passwords, full card numbers, CVV/CVC, or unnecessary identity documents.
